DHL EXPRESS (AUSTRALIA) PTY LTD (ABN 62 001 112 929) (‘DHL’ or the ‘Promoter’)


1. Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.


2. Entry is open to all permanent residents of Australia over the age of eighteen (18) years to whom, in their capacity as an authorised representative of certain specific companies or businesses (‘Eligible Businesses’), the Promoter sends an email or other communication in writing on or before the end of the Promotional Period with an invitation to participate, or notification that they are eligible to participate, in the Promotion (‘Eligible Entrant’). Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this Promotion are ineligible to enter.


3. Promotion commences at 10:00 am AEST on Wednesday, 31 August 2022 and final entries close at 11.59 pm AEST on Wednesday, 21 September 2022 (’Promotional Period’).


4. DHL will provide Eligible Entrants with a link to the survey (the ‘Survey’).


5. DHL reserves the right to extend the competition for any reason.


6. A submitted and completed Survey, accompanied by an answer to the question ‘Explain in 25 words or less how your business will benefit from the findings of the DHL Export Barometer 2022’ will count for one (1) entry (‘Eligible Entry’) into this Promotion to win one (1) gift card, valued at two thousand five hundred dollars (AU$2,500) (the ‘Prize’). The Promotion is limited to one (1) Eligible Entry per Eligible Entrant.


7. An Eligible Entrant must complete the online survey in full via the link and submit it as set out above. Judging will be conducted by one or more representatives of the Promoter and the winning entry selected, based on the insightfulness, informativeness and value of the entry, from the total Eligible Entries received during the Promotional Period on or before Wednesday, 19 October 2022 at 10.00 am (AEST) the (‘Selection Date’) at the Promoter’s premises. The Prize winner will be notified by email, which shall also constitute notice, within 120 days of the Selection Date (or Unclaimed Prize Selection Date, as relevant). The Promoter may, but is not obliged to, publish the names of winning Eligible Entrants. The Promoter’s decision is final and no correspondence will be entered into.


8. The Prize must be taken as offered and cannot be varied. The Prize value is correct as at the time of printing. Prizes are subject to any conditions imposed by the particular manufacturer, supplier or organiser of the Prize. If any Prize (or part of the Prize) is unavailable, DHL, in its absolute discretion, reserves the right to substitute the Prize (or that part of the Prize) with another Prize of similar value or cancel the competition. DHL does not guarantee the quality of the Prizes or make any warranty in relation to the Prizes. DHL accepts no responsibility for any tax liabilities that may arise from winning a Prize. The Promoter accepts no responsibility for any variation in the Prize value.


9. A second draw for the Prize, if unclaimed, may take place on Wednesday, 2 November 2022 (‘Unclaimed Prize Selection Date’) at the same time and place as the original draw, subject to any written directions from a regulatory authority. The Prize winner(s) will be notified by email, which shall also constitute notice, within 120 days of the Unclaimed Prize Selection Date, as relevant.


10. Eligible Entrants and Eligible Businesses who enter the Promotion, consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Each Eligible Entrant warrants that that it is the owner of, and holds all intellectual property, moral or other rights in, the Eligible Entry it has submitted. At the time of submitting an Eligible Entry, each Eligible Entrant gives the Promoter an unconditional and irrevocable licence to use all intellectual property, moral or other rights in the Eligible Entry, including for promotional and advertising purposes.


11. SUBJECT TO ANY WRITTEN DIRECTIONS FROM A REGULATORY AUTHORITY, THE PROMOTER MAY MODIFY, SUSPEND, TERMINATE OR CANCEL THE PROMOTION AT ANY TIME, IF THE PROMOTER DETERMINES THAT THERE ARE GROUNDS FOR DOING SO, IN ITS DISCRETION. Without limiting the foregoing, this may include where this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud.


12. Subject to any written directions from a regulatory authority, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to disqualify any Eligible Entrant or Eligible Entry if the promoter determines that there are grounds for doing so, in its discretion. Without limiting the foregoing, the Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant if they submit an entry that is not in accordance with these Terms and Conditions or tamper with the entry process, or if there is fraud in connection with an entry. Errors and omissions may be accepted at the Promoter’s discretion. Incomplete or illegible entries will not be eligible for this Promotion, and incomplete or indecipherable entries will be deemed invalid, unless the Promoter exercises their discretion. Failure by the Promoter to enforce any of its rights, or the rules of this Promotion, at any stage does not constitute a waiver of those rights or rules.


13. Any cost associated with accessing the promotional website or participating in this Promotion is the Eligible Entrant’s responsibility, and is dependent on the Internet service provider used.


14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Law Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia, which are not capable of being limited, excluded or modified at law (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) in connection with this Promotion. Without limiting the foregoing, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury; or any loss or damage (including loss of opportunity, breach of confidence, breach of privacy); whether direct, indirect, special or consequential, arising in any way in connection with this Promotion including without limitation: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Entrant or their Business; or (f) use of the Prize.


15. The Promoter collects personal information of Eligible Entrants and authorised representatives of Eligible Businesses in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers (such as any Promotion Administrator, Prize suppliers and deliverers), Prize suppliers and, as required, to Australian and New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the authorised representative. The DHL privacy policy available at contains information about how an Eligible Entrant may access their personal information which is held by DHL and seek the correction of such information, as well as how an Eligible Entrant may complain about a breach of the Australian Privacy Principles, and how DHL will deal with such a complaint.


16. All entries and all completed surveys become the property of the Promoter.
